Newly promulgated guardian regulations for the protection of the geographical indications and of the origin denominations for the agricultural/food products

The Government Decision no. 828 of 25/07/2007, published in the Official Gazette no.556 of 14/08/2007, institutes the legal grounds for the establishment of the System for the protection of the geographical indications and of the agricultural and food product origin denominations.

The provisions of the law generally stipulate the responsible Romanian authorities and their duties, regarding the legal compliance of the documentation for obtaining the protection of a geographical indication, or of an origin denomination for agricultural/food products, as well as being in charge with the labeling legal compliance and also with the verification of the national or European Community logo use.

Basically, the provisions of the law were being drafted in close resemblance of the European Council Regulation nr.510/2006, in view of the desired harmonization, into this particular field of protection.

A distinct aspect introduced by the law is the setting up of independent inspection and certification bodies, legal entities recognized by the Agricultural and Rural Development Ministry and being established in compliance with the provisions of Art.11, align.3, European Council Regulation nr. 510/2006.

This individual inspection and certification bodies will be accredited in compliance with the European Standards EN 45011 and with the standards ISO/CEI 65. Their activity will be verified and monitored by the Agricultural and Rural Development Ministry.

Finally, the law refers to the market verification of the labeling and the use of the national or European Community logo, issues for with is responsible the National Authority for the Consumers Protection.

The registration and verification procedure, the opposition procedure, as well as the regulations for the use of the national and European Community logo, are to be approved separately, through the Order of the Minister of Agricultural and Rural Development Ministry.
